US Special Counsel Jack Smith filed a superseding indictment in the election interference case against former President Donald Trump on Tuesday, reducing the scope of the claims in light of a recent Supreme Court decision on immunity. “The superseding indictment, which was presented to a new grand jury that had not previously heard evidence in this case, reflects the government’s efforts to respect and implement the Supreme Court’s holdings and remand instructions in Trump v. United States,” several US media outlets quoted the special counsel’s office as saying.
While none of Trump’s four original counts have been withdrawn, CNN reports that the new indictment excludes key allegations, including those involving attempts to utilize the Justice Department to back Trump’s false claims of election fraud. It followed the Supreme Court’s ruling last month that Trump is entitled to certain immunity from prosecution for official acts but not for actions taken as a candidate.
Smith is prosecuting Trump for criminally interfering in the 2020 presidential election, while the former president’s legal team has been attempting to have the election meddling case dismissed on grounds of presidential immunity. The decision might potentially influence the lawsuit against Trump in Florida for taking secret papers from his term in office with him as a private citizen and refusing to return them to the government
